OTHER - OPCD - NOTICE OF PROPOSED ZONING CODE CHANGES FOR CONVERSIONS TO RESIDENTIAL USES AND DNS
Project Description:
The Office of Planning and Community Development (OPCD) is proposing to make changes to the land use code to facilitate the conversion of nonresidential uses to residential uses in existing buildings. The proposal would apply in any downtown or commercial zone, and in the Seattle Mixed (SM), Highrise (HR), and Midrise (MR) zones. The proposed legislation includes the following components:
1. Adds a new Section “Conversion to residential use in an existing structure” to Chapter 23.40 – the exceptions chapter of the code, and provides an exemption for eligible conversion projects from most development standards in the land use code.
2. Provides an exemption from the Mandatory Housing Affordability (MHA) residential requirements for eligible conversions from nonresidential to residential use.
3. Clarifies that design review is not required for eligible conversions.
4. Provides flexibility for unbuilt developments with an unexpired Master Use Permit to convert floor area from a nonresidential to a residential use without restarting the permitting process.
The department’s intent for this proposal is to support Mayor Harrell’s Downtown Activation Plan and to increase housing supply.
